Article 1 In order to regulate the motor vehicle maintenance business activities, maintain the order of the motor vehicle maintenance market, protect the legitimate rights and interests of the parties involved in motor vehicle maintenance, ensure the safety of motor vehicle operation, protect the environment, save energy, and promote the healthy development of the motor vehicle maintenance industry These regulations are formulated in accordance with the "Road Transportation Regulations of the People's Republic of China" and relevant laws and administrative regulations.
Article 2 Those engaged in motor vehicle maintenance operations shall abide by these regulations.
The term “motor vehicle maintenance operations†as mentioned in these Provisions refers to maintenance, repairs, repairs, rescues and other related business activities carried out with the task of maintaining or restoring the technical status and normal functions of motor vehicles and extending the life of motor vehicles.
Article 3 Motor vehicle maintenance operators shall operate in accordance with the law, with honesty and credibility, fair competition, and high-quality services.
Article 4 The maintenance management of motor vehicles shall be fair, just, open and convenient.
Article 5 No unit or individual may block or monopolize the motor vehicle maintenance market.
Encourage motor vehicle maintenance enterprises to implement intensive, specialized, and chain operations, and promote a reasonable division of labor and coordinated development of the motor vehicle maintenance industry.
Encourage the promotion and application of motor vehicle maintenance environmental protection, energy saving, non-disintegration detection and fault diagnosis technologies, promote industry information construction and rescue, maintenance service network construction, improve the overall quality of the motor vehicle maintenance industry to meet social needs.
Article 6 The Ministry of Communications is in charge of the nationwide motor vehicle maintenance management.
The competent transportation department of the local people's government at or above the county level is responsible for organizing and leading the maintenance and management of motor vehicles in its administrative area.
The road transportation management agency at or above the county level is responsible for the specific implementation of the maintenance management of motor vehicles within its administrative area.
Chapter II Business License
Article 7 Motor vehicle maintenance operations are subject to classified licenses based on the types of maintenance models, service capabilities, and operating items.
Motor vehicle maintenance operations are divided into four categories according to maintenance objects: automobile maintenance operations, dangerous goods transportation vehicle maintenance operations, motorcycle maintenance operations, and other motor vehicle maintenance operations.
Automobile maintenance business and other motor vehicle maintenance business are divided into first-class maintenance business, second-type maintenance business and third-type maintenance business according to operating items and service capabilities.
Motorcycle maintenance business is divided into first-class maintenance business and second-class maintenance business according to operating items and service capabilities.
Article 8 Those who have obtained the first-class vehicle maintenance business and the first-type other motor vehicle maintenance business license may engage in vehicle repair, assembly repair, vehicle maintenance, minor repair, maintenance and rescue, special repair and maintenance completion inspection Work; if you get the second-class vehicle maintenance business operation and the second-class other motor vehicle maintenance business operation license, you can engage in vehicle repair, assembly repair, vehicle maintenance, minor repair, repair and rescue and special repair work of the corresponding vehicle type; get three categories If the vehicle maintenance business and the three types of other vehicle maintenance business operations are permitted, they can be engaged in engine, body, electrical system, automatic transmission maintenance and body cleaning maintenance, painting, tire dynamic balancing and repair, four-wheel positioning detection adjustment, supply Oil system maintenance and oil product replacement, fuel injection pump and fuel injector repair, crankshaft repair, cylinder boring, radiator (water tank), air conditioning repair, vehicle decoration (tarpaulin, cushion and interior decoration), vehicle glass installation and other special items jobs.
Article 9 Those who have obtained the first-class motorcycle repair business license may engage in whole-cycle motorcycle repair, assembly repair, whole-vehicle maintenance, minor repair, special repair and completion inspection; those who have obtained the second-class motorcycle repair business license, Can be engaged in motorcycle maintenance, minor repairs and special repair work.
Article 10 Those who have obtained permits for the operation and maintenance of dangerous goods transportation vehicles shall not only be engaged in the maintenance business of dangerous goods transportation vehicles, but also engage in the first-class vehicle maintenance business.
Article 11 Anyone who applies for car maintenance business or other motor vehicle maintenance business shall meet the following conditions:
(1) There is a maintenance vehicle parking lot and production plant suitable for its business operations. The leased space shall have a written lease contract, and the lease term shall not be less than 1 year. The parking lot and the area of ​​the production plant are implemented in accordance with the relevant provisions of the national standard "Conditions for the Opening of the Automotive Maintenance Industry" (GB / T16739).
(2) Having equipment and facilities suitable for its business operations. The equipped measuring equipment shall meet the requirements of relevant national technical standards and be qualified by the legal inspection agency. The specific requirements for equipment and facilities engaged in automobile maintenance business shall be implemented in accordance with the relevant provisions of the national standard "Conditions for the Opening of Automobile Maintenance Industry" (GB / T16739); for the specific requirements of equipment and facilities engaged in other motor vehicle maintenance business, refer to the country The standard "Conditions for the Opening of the Automotive Maintenance Industry" (GB / T16739) is implemented, but the facilities and equipment provided should be compatible with the models it maintains.
(3) Necessary technical personnel:
1. Those engaged in Type I and Type II maintenance business shall be equipped with at least one technically responsible person and quality inspector respectively. The person in charge of technology should be familiar with the maintenance business of automobiles or other motor vehicles, and master the maintenance of automobiles or other motor vehicles and related policies, regulations, and technical specifications; the quality inspectors should be familiar with the specifications for the maintenance and inspection of various types of automobiles or other motor vehicles, and master the automobile or other Relevant technologies for fault diagnosis and quality inspection of motor vehicle maintenance, familiar with charging standards for automobile or other motor vehicle maintenance services, and related policies, regulations and technical specifications. 60% of the total number of technically responsible personnel and quality inspection personnel shall pass the national unified examination.
2. Those engaged in Type 1 and Type 2 maintenance business should be equipped with at least one maintenance technician who is engaged in mechanical repair, electrical appliances, sheet metal, and painting; the maintenance technician who is engaged in mechanical repair, electrical appliances, sheet metal, and painting should be familiar with The maintenance technology and operation specifications of the type of work, and understand the maintenance of automobiles or other motor vehicles and related policies and regulations. 40% of the total number of technicians for machine repair, electrical appliances, sheet metal, and paint maintenance should pass the national unified examination.
3. Those engaged in three types of maintenance business shall be equipped with corresponding maintenance technicians for electrical repair, electrical appliances, sheet metal, and lacquer according to their operating projects; those engaged in engine repair, body repair, electrical system repair, and automatic transmission repair shall also be equipped Technical responsible personnel and quality inspection personnel. 40% of the total number of technically responsible personnel, quality inspection personnel, and mechanics, electrical appliances, sheet metal, paint repair technicians should pass the national unified examination.
(4) Have a sound maintenance management system. Including quality management system, safety production management system, vehicle maintenance file management system, personnel training system, equipment management system and parts management system. The specific requirements shall be implemented in accordance with the relevant provisions of the national standard "Conditions for the Opening of the Automotive Maintenance Industry" (GB / T16739).
(5) Necessary environmental protection measures. The specific requirements shall be implemented in accordance with the relevant provisions of the national standard "Conditions for the Opening of the Automotive Maintenance Industry" (GB / T16739).
Article 12 Automobile maintenance operators engaged in the maintenance of dangerous goods transportation vehicles shall have the following conditions in addition to the opening conditions for the first-class maintenance operations of automobile maintenance operations:
(1) There are special maintenance workshops and equipment and facilities suitable for the content of their operations, and obvious indicator signs are set;
(2) There is a comprehensive emergency response plan for emergencies. The emergency response plan includes reporting procedures, emergency command and disposal measures;
(3) Have corresponding safety management personnel;
(4) Complete safety operation procedures.
The maintenance of dangerous goods transportation vehicles mentioned in these regulations refers to the maintenance of motor vehicles transporting flammable, explosive, corrosive, radioactive, highly toxic and other goods, and does not include the maintenance of the tanks of dangerous goods transportation vehicles.
Article 13 Anyone applying for motorcycle maintenance shall meet the following conditions:
(1) There is a motorcycle maintenance parking lot and a production plant suitable for its business operations. The leased space shall have a written lease contract, and the lease term shall not be less than 1 year. The area of ​​the parking lot and the production plant shall be implemented in accordance with the relevant provisions of the national standard "Conditions for the Opening of Motorcycle Repair Industry" (GB / T18189).
(2) Having equipment and facilities suitable for its business operations. The equipped measuring equipment shall meet the requirements of relevant national technical standards, and shall be qualified by the legal inspection agency. The specific requirements shall be implemented in accordance with the relevant provisions of the national standard "Start-up Conditions for Motorcycle Repair Industry" (GB / T18189).
(3) Necessary technical personnel:
1. At least one quality inspector should be engaged in the first-class maintenance business. Quality inspectors should be familiar with various types of motorcycle maintenance inspection operation specifications, master the related technologies of motorcycle maintenance fault diagnosis and quality inspection, and be familiar with motorcycle maintenance service charging standards and related policies, regulations and technical specifications. 60% of the total number of quality inspectors shall pass the national unified examination.
2. According to their business operations, they are equipped with corresponding maintenance technicians for machine repair, electrical appliances, sheet metal, and painting. The maintenance technicians of machine repair, electrical appliances, sheet metal, and paint should be familiar with the maintenance technology and operating specifications of the type of work they are engaged in, and understand the motorcycle maintenance and related policies and regulations. 30% of the total number of technicians for machine repair, electrical appliances, sheet metal, and paint maintenance should pass the national unified examination.
(4) Have a sound maintenance management system. Including quality management system, safety production management system, motorcycle maintenance file management system, personnel training system, equipment management system and accessories management system. The specific requirements shall be implemented in accordance with the relevant provisions of the national standard "Start-up Conditions for Motorcycle Repair Industry" (GB / T18189).
(5) Necessary environmental protection measures. The specific requirements shall be implemented in accordance with the relevant provisions of the national standard "Start-up Conditions for Motorcycle Repair Industry" (GB / T18189).
Article 14 Anyone applying to engage in motor vehicle maintenance operations shall submit an application to the local county-level road transportation management agency and submit the following materials:
(1) "Application for Transportation Administrative License";
(2) Copy of the operating site, parking lot area materials, land use rights and property rights certificates;
(3) Summary table of technical personnel and corresponding professional qualification certificates;
(4) A copy of the certification of maintenance testing equipment and measurement equipment;
(5) According to the maintenance operations of automobiles, other motor vehicles, dangerous goods transportation vehicles, and motorcycles, provide other relevant materials under the conditions stipulated in Articles 11, 12 and 13 of these Provisions respectively.
Article 15 The road transport management agency shall implement the administrative license for motor vehicle maintenance operations in accordance with the procedures regulated by the "Regulations on Road Transport of the People's Republic of China" and the "Provisions on the Procedures for the Implementation of Traffic Administrative Licenses."
Article 16 If a road transportation management agency accepts an application for motor vehicle maintenance and management, it shall make a decision on whether or not to grant permission within 15 days from the date of acceptance of the application. If the statutory conditions are met, the road transport management agency makes a decision to grant an administrative license, issues a "Traffic Administrative Permission Decision" to the applicant, and issues a license for motor vehicle maintenance and operation to the licensee within 10 days, specifying the permit matters; it does not meet the statutory requirements If conditions permit, the road transport management agency shall make a decision not to grant permission, issue an "Approval Decision on Not Approving Traffic" to the applicant, explain the reasons, and inform the applicant of the right to apply for administrative reconsideration or to bring an administrative lawsuit according to law.
Motor vehicle maintenance operators shall carry out relevant registration formalities with the industrial and commercial administrative organs in accordance with the law with motor vehicle maintenance and operation licenses.
